• 2.2. Authority: By accessing the Services, you confirm that you have the capacity to understand and accept these Terms.
• 2.3. Account Security: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account.

3. Intellectual Property Rights

• 3.1. Ownership: All content included in the Services, such as text, graphics, logos, test questions, assessment algorithms, and software, is the property of Greenguide Solution Private Limited and is protected by Indian and international copyright and trademark laws.
• 3.2. License: We grant you a limited, non-exclusive, non-transferable license to access and use the DNA test for your personal, non-commercial use.
• 3.3. Restrictions: You strictly may not:
  • Copy, reproduce, distribute, or publicly display any part of the DNA test questions or reports.
  • Reverse engineer, decompile, or attempt to extract the source code or scoring algorithms of the test.
  • Share your account access with others to allow multiple people to take the test under one purchase.

4. Privacy and Data Usage (Lead Generation Consent)

• 4.1. Data Collection: By using the Services, you acknowledge that we collect personal information, including your name, contact details, academic preferences, and test performance data.
• 4.2. Consent to Contact: By registering for the DNA test, you expressly consent to receive marketing communications from Greenguide Solution Private Limited and our educational partners via email, SMS, WhatsApp, or phone calls regarding test prep courses, exam notifications, and career counselling.
• 4.3. Data Usage: You agree that your test results and profile data may be used by us to:
  • Generate your personalized DNA report.
  • Recommend specific courses, coaching programs, or colleges that match your aptitude profile.
  • Improve our internal algorithms and benchmarking data (in an anonymized format).

5. User Conduct

You agree not to:

• Provide false or misleading information regarding your identity or academic background.
• Use the Services for any illegal purpose or in violation of any local, state, or national law.
• Interfere with or disrupt the security, integrity, or performance of the Site.

6. Payment and Refund Policy

• 6.1. Pricing: Prices for the DNA test and related reports are listed on the Site and are subject to change without notice.
• 6.2. No Refunds: Due to the digital nature of the DNA test and the immediate availability of the assessment report, all sales are final. Once the test has been started or the report generated, no refunds or cancellations will be issued.
• 6.3. Exceptions: In the event of a proven technical failure on our part (e.g., the report was not generated after payment), we will, at our discretion, either issue a refund or provide a free re-take of the test.

7. Disclaimers regarding Test Results

• 7.1. Advisory Tool: The DNA test is a guiding tool meant for educational and self-assessment purposes only. The report is based on psychometric analysis of your responses at a specific point in time.
• 7.2. No Guarantee: The results are not a guarantee of success or failure in any future competitive exam (e.g., CAT, UPSC, JEE, SSC) or career path.
• 7.3. No Professional Advice: The Services do not constitute medical, psychological, or certified career counseling advice. We recommend using these results as one of many inputs when making career decisions.
• 7.4. "As Is" Basis: The Services are provided on an "as is" and "as available" basis without warranties of any kind.

8. Limitation of Liability

To the fullest extent permitted by law, Greenguide Solution Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of the DNA test.

9. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.
